49 CFR Part 395 Overview
The Federal Motor Carrier Safety Regulations governing Hours of Service and Electronic Logging Devices.
- Applies to CMV drivers required to maintain records of duty status (RODS) under 49 CFR 395.8
- The ELD must be registered on the FMCSA ELD list at eld.fmcsa.dot.gov prior to use
- Device must automatically record engine data: engine hours, vehicle miles, date/time, location, and driver ID
- Must support data transfer via Web Services and Email to authorized safety officials
- Driver logs must be retained on the ELD for a minimum of 6 months
- Drivers must be able to annotate, edit, and certify their logs within the ELD interface

Who is subject: The ELD mandate applies to CMV drivers in interstate commerce who are required to hold a CDL, and to any driver who is required to keep records of duty status (RODS) under 49 CFR Part 395.

Recording Capabilities
- Engine on/off events with precise timestamp and location
- Vehicle motion detection (threshold: 5 mph sustained for 1+ minutes)

Data Transfer Methods
ERETHELD ERS238 supports all FMCSA-required data transfer methods for roadside inspections.
FMCSA Web Services
- 1Open the DOT Inspection mode in the ERETHELD dashboard
- 2Select "Web Services" as the transfer method
- 3Enter the officer's USDOT number (provided by the officer at the time of inspection)
- 4Tap "Send" — the secure transfer completes in under 5 seconds
- 5The officer receives the ELD output file on the FMCSA portal instantly
Email Transfer
- 1Open the DOT Inspection mode in the ERETHELD dashboard
- 2Select "Email Transfer" as the transfer method
- 3Enter the officer's official email address (provided by the officer)
- 4Tap "Send" — the ELD log file is sent as a secure attachment
- 5Standard FMCSA format: ELD Output File (.csv or .txt per specification)
Local Display (On-Screen Review)
Drivers can also display their ELD logs directly on-screen for officer review without transmitting any data. The on-screen display presents all required data elements in a readable format as specified by 49 CFR Part 395. This method is available at all times regardless of connectivity status.
Malfunction & Diagnostic Codes
ERETHELD monitors 9 malfunction codes and 6 diagnostic event codes as required by 49 CFR 395.34. The device will display a warning indicator when any malfunction or diagnostic event is detected.

(1) Note the malfunction on the current log page as soon as it is detected; (2) Reconstruct records of duty status on paper for the current 24-hour period and the previous 7 consecutive days; (3) Continue using paper logs until the ELD malfunction is repaired — maximum of 8 days is permitted; (4) Notify the motor carrier within 24 hours of the malfunction. The motor carrier must repair or replace the ELD within 8 days.
