The Federal Motor Carrier Safety Regulations governing Hours of Service and Electronic Logging Devices.

ERETHELD ERS238 is certified compliant with 49 CFR Part 395, Subpart B — Electronic Logging Devices
  • Applies to CMV drivers required to maintain records of duty status (RODS) under 49 CFR 395.8
  • The ELD must be registered on the FMCSA ELD list at eld.fmcsa.dot.gov prior to use
  • Device must automatically record engine data: engine hours, vehicle miles, date/time, location, and driver ID
  • Must support data transfer via Web Services and Email to authorized safety officials
  • Driver logs must be retained on the ELD for a minimum of 6 months
  • Drivers must be able to annotate, edit, and certify their logs within the ELD interface

Mandate & Applicability

ELD Mandate Requirements

Who is required to use an ELD, who qualifies for exemptions, and the compliance timeline.

Who is subject: The ELD mandate applies to CMV drivers in interstate commerce who are required to hold a CDL, and to any driver who is required to keep records of duty status (RODS) under 49 CFR Part 395.

Exemptions

Short-haul drivers (within 150 air-mile radius, returning to home terminal same day) Driveaway-towaway operations where the driven vehicle is the commodity being transported Vehicles manufactured before model year 2000 CDL drivers who use paper RODS for 8 or fewer days in any 30-day period

Penalties for Non-Compliance Non-compliance with the ELD mandate can result in the commercial vehicle being placed out-of-service immediately, preventing further operation until the violation is resolved. Civil penalties can reach $16,000 per violation, and patterns of non-compliance may result in increased scrutiny and audits by the FMCSA.

Recording Capabilities

DOT Roadside Inspections

Data Transfer Methods

ERETHELD ERS238 supports all FMCSA-required data transfer methods for roadside inspections.

FMCSA Web Services

  1. 1Open the DOT Inspection mode in the ERETHELD dashboard
  2. 2Select "Web Services" as the transfer method
  3. 3Enter the officer's USDOT number (provided by the officer at the time of inspection)
  4. 4Tap "Send" — the secure transfer completes in under 5 seconds
  5. 5The officer receives the ELD output file on the FMCSA portal instantly
Preferred method per FMCSA guidelines. Data transmitted via encrypted TLS connection directly to the FMCSA server.

Email Transfer

  1. 1Open the DOT Inspection mode in the ERETHELD dashboard
  2. 2Select "Email Transfer" as the transfer method
  3. 3Enter the officer's official email address (provided by the officer)
  4. 4Tap "Send" — the ELD log file is sent as a secure attachment
  5. 5Standard FMCSA format: ELD Output File (.csv or .txt per specification)
Fallback method when web services are unavailable. The officer must provide their official email address for log receipt.

Local Display (On-Screen Review)

Drivers can also display their ELD logs directly on-screen for officer review without transmitting any data. The on-screen display presents all required data elements in a readable format as specified by 49 CFR Part 395. This method is available at all times regardless of connectivity status.

Malfunction & Diagnostic Codes

ERETHELD monitors 9 malfunction codes and 6 diagnostic event codes as required by 49 CFR 395.34. The device will display a warning indicator when any malfunction or diagnostic event is detected.

Code Description
1 Power Data Diagnostic — ELD not powered for required duration
2 Engine Synchronization Data Diagnostic — ECM data missing for >30 minutes
3 Missing Required Data Elements — one or more fields not recorded
4 Data Transfer Data Diagnostic — failed transfer attempt logged
5 Unidentified Driving Records — driving recorded without assigned driver
6 Other Data Diagnostic — miscellaneous data integrity event
If a malfunction occurs, the driver must:
(1) Note the malfunction on the current log page as soon as it is detected;  (2) Reconstruct records of duty status on paper for the current 24-hour period and the previous 7 consecutive days;  (3) Continue using paper logs until the ELD malfunction is repaired — maximum of 8 days is permitted;  (4) Notify the motor carrier within 24 hours of the malfunction. The motor carrier must repair or replace the ELD within 8 days.
